- Prohibition

65

A judge is not to hear the argument of one party when the other party is not there.

“Do not take up a false report” Shmos 23:1

A party to a dispute is adjured not to present his evidence to the judge before the other litigant arrives.

We read the text “do not take up” as “do not cause to be taken up.”

Included in this prohibition is not to accept or relate evil slander nor give false testimony.

This applies in all places at all times for judges and litigants both men and women.

A judge to not hear the argument of one party when the other party is not there.
